Welcome to DS Billing. These Terms of Service ("Terms") govern your access to and use of the DS Billing website, software, mobile applications, and related services (collectively, the "Services"). By registering for, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.
If you do not agree with any part of these Terms, you must discontinue use of the Services immediately.
1. Acceptance of TermsBy creating an account, accessing, or using DS Billing, you enter into a legally binding agreement with DS Billing. These Terms apply to all users, including business owners, employees, administrators, accountants, consultants, and any authorised representatives using the platform.
You confirm that:
- You are at least 18 years of age.
- You have the legal authority to represent your organisation, if applicable.
- All information provided during registration is accurate, complete, and current.
DS Billing is a cloud-based business management platform designed to help businesses streamline daily operations.
Our Services may include, but are not limited to:
- GST Billing & Tax Invoicing
- Point of Sale (POS)
- Inventory & Stock Management
- Sales & Purchase Management
- Customer & Supplier Management
- Expense Management
- Barcode & Label Printing
- Financial Reports & Analytics
- Multi-user Access & Role Management
- Business Dashboard
- Data Backup & Synchronisation
- API Integrations and Third-Party Services
Features available to you depend on your selected subscription plan. We reserve the right to add, modify, discontinue, or improve features without prior notice where reasonably necessary.
3. Account Registration & SecurityTo access certain Services, you must create an account.
You agree to:
- Provide accurate and complete registration information.
- Keep your account credentials confidential.
- Maintain the security of your password and devices.
- Promptly notify us of any unauthorised access or suspected security breach.
- Ensure that employees or authorised users comply with these Terms.
You are solely responsible for all activities carried out under your account unless caused by our negligence.
4. Acceptable Use PolicyYou agree to use DS Billing only for lawful business purposes.
You must not:
- Access another user's account without permission.
- Upload viruses, malware, or malicious code.
- Attempt to bypass security measures.
- Reverse engineer, copy, modify, or distribute the software unlawfully.
- Interfere with the performance or availability of the Services.
- Use the platform for fraudulent, illegal, or deceptive activities.
- Upload content that infringes intellectual property or applicable laws.
Violation of this policy may result in immediate suspension or permanent termination of your account.
5. Customer ResponsibilitiesYou remain solely responsible for:
- The accuracy of invoices, GST records, and financial information.
- Compliance with GST, Income Tax, and other applicable laws.
- Maintaining backup copies where legally required.
- Reviewing reports before filing statutory returns.
- Managing user permissions within your organisation.
DS Billing provides software tools only and does not provide accounting, tax, or legal advice.
6. Subscription, Billing & PaymentsCertain Services require payment of subscription fees.
By subscribing, you agree that:
- Subscription fees are payable in advance.
- Pricing may vary depending on your selected plan.
- Applicable GST and other taxes will be charged where required by Indian law.
- Failure to make timely payments may result in suspension or termination of Services.
- Continued use after renewal constitutes acceptance of the applicable subscription charges.
Unless otherwise stated, subscription fees are non-refundable except where required by law or under our Cancellation & Refund Policy.
7. Intellectual Property RightsAll intellectual property rights relating to DS Billing, including but not limited to:
- Software
- Source code
- Databases
- User interface
- Graphics
- Logos
- Trademarks
- Documentation
- Website content
are owned by DS Billing or its licensors and are protected under applicable intellectual property laws.
Your subscription grants only a limited, non-exclusive, non-transferable, revocable licence to use the Services for legitimate business purposes.
No ownership rights are transferred to you.
8. Ownership of Customer DataYou retain ownership of all business data, customer records, invoices, inventory information, reports, and documents uploaded or created through DS Billing.
By using the Services, you grant DS Billing a limited licence to process, store, back up, and transmit your data solely for:
- Providing the Services
- Technical support
- Security monitoring
- System maintenance
- Legal compliance
We do not sell your business data to third parties.

9. Data SecurityWe employ commercially reasonable administrative, technical, and organisational measures to safeguard customer information.
While we strive to maintain high levels of security, no internet-based system can guarantee absolute security. Users are responsible for maintaining secure passwords and protecting access to their own devices.
10. Third-Party ServicesOur Services may integrate with third-party software, payment gateways, APIs, cloud providers, or government portals.
DS Billing is not responsible for:
- Third-party outages
- Policy changes
- Service interruptions
- Data provided by third parties
- Third-party terms or privacy practices
Your use of third-party services is governed by their respective terms and policies.
11. Service AvailabilityWe aim to provide reliable and uninterrupted Services. However, access may occasionally be affected by:
- Scheduled maintenance
- Emergency updates
- Technical failures
- Internet disruptions
- Events beyond our reasonable control
We do not guarantee uninterrupted or error-free operation.
12. Disclaimer of WarrantiesThe Services are provided on an "as is" and "as available" basis.
To the fullest extent permitted by applicable law, DS Billing disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Users should independently verify invoices, tax calculations, statutory filings, and financial reports with qualified professionals where appropriate.
13. Limitation of LiabilityTo the fullest extent permitted by law, DS Billing, its directors, employees, affiliates, partners, and licensors shall not be liable for any:
- Indirect damages
- Incidental damages
- Special damages
- Consequential damages
- Loss of profits
- Loss of goodwill
- Business interruption
- Data loss
- Revenue loss
arising from your use of the Services.
Our aggregate liability for any claim shall not exceed the total subscription fees paid by you to DS Billing during the twelve (12) months immediately preceding the event giving rise to the claim.
14. Suspension and TerminationWe reserve the right to suspend or terminate your account without prior notice if you:
- Violate these Terms.
- Engage in fraudulent or unlawful activities.
- Attempt to compromise platform security.
- Fail to pay applicable subscription fees.
- Misuse or abuse the Services.
You may terminate your subscription at any time in accordance with our Cancellation & Refund Policy.
Termination does not relieve you of any outstanding payment obligations accrued before termination.
15. Changes to the ServicesWe continually improve our platform and may modify, replace, or discontinue features, pricing, functionality, or Services. Where appropriate, we will provide reasonable notice of material changes.
Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
16. Governing Law & JurisdictionThese Terms shall be governed by and interpreted in accordance with the laws of the Republic of India.
Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts in India.
